1. Operator and Scope
These terms govern the use of the website swiss-helicopter-club.ch (hereinafter the platform), operated by OM Niederer, c/o ExpertFid and Audit SA, Strehlgasse 2, 8001 Zurich (hereinafter we or the operator). By using the platform, and in particular by submitting an enquiry, you agree to these terms.
2. Purpose of the Platform
The platform is a neutral directory and an intermediary platform for helicopter experiences, flights and training offers in Switzerland. We list operators and their offers, enable comparison and forward enquiries to the operator or flight school you have selected.
3. No Contractual Partnership, Pure Intermediation
We do not provide any flight, transport or training services ourselves and act neither as an operator nor as a tour operator. Any contract for an experience, a flight or training is concluded exclusively and directly between you and the respective operator or flight school. We are not a party to that contractual relationship.
4. Enquiries Are Not a Booking
An enquiry submitted via the platform is non-binding and does not constitute a booking. Binding information on availability, price, services and conditions is provided to you directly by the operator. The respective operator's terms govern the service.
5. Directory Information, No Warranty
We strive to keep directory information current, correct and complete. However, we do not warrant the accuracy, completeness, availability or timeliness of the information, prices and services, as these originate from the respective operator and may change.
6. Affiliate and Partner Links
The platform may contain affiliate or partner links for which we may receive compensation in the event of a referral. This has no influence on the neutrality of the directory. Details can be found in our affiliate disclosure.
7. User Obligations
You undertake to provide truthful information in enquiries and not to misuse the platform, in particular not for unlawful, misleading or automated bulk requests.
8. Liability
We are not liable for the services of the operators and flight schools, for the accuracy of the directory information or for the content of linked external websites. Otherwise, to the extent permitted by law, our liability is limited to intent and gross negligence; liability for slight negligence and for auxiliary persons is excluded to the extent permitted by law. Mandatory statutory liability, in particular under Art. 100 of the Swiss Code of Obligations and under product liability law, remains reserved.
9. Intellectual Property
The content, structure and design of the platform are protected. Any use beyond the intended use requires our prior consent.
10. Changes to These Terms
We may amend these terms at any time. The version published at the time of use of the platform is authoritative.
11. Applicable Law and Jurisdiction
Swiss substantive law applies exclusively, to the exclusion of the conflict-of-law rules of private international law and the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is, to the extent permitted by law, Zurich.
12. Severability
Should any provision be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
